Copyright and Intellectual Property Policy

DanceRecords.com is an Online Service Provider under Title II of the Digital Millennium Copyright Act, 17 U.S.C. Section 512 ("DMCA"). DanceRecords.com respects the intellectual property of others, and we ask our users to do the same.

It is DanceRecords.com’s policy, in appropriate circumstances and at its discretion, to disable and/or terminate the accounts of users who may infringe or repeatedly infringe the copyrights or other intellectual property rights of DanceRecords.com and/or others. We have appointed Joseph Teegarden as our copyright agent to receive notifications of claimed infringement and have informed the U.S. Copyright Office of this appointment. Infringement Notification

Pursuant to the Act, the claimant will be liable for damages, including costs and attorneys fees if the claimant misrepresents that a product or activity is infringing it’s copyrights. If a claimant is not sure whether material infringes its copyrights, DanceRecords.com recommends the claimant first consult an attorney.

If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, please provide Joseph Teegarden with the following information:

  1. Identify the copyrighted work or other intellectual property that you claim has been infringed.
  2. Identify the material that you claim is infringing on the DanceRecords.com site, with enough detail that we may find it on the web site;
  3. Your true name, address, telephone number, and email address.
  4. A statement by you that you have “a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law.
  5. A statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.
  6. An electronic or physical signature of the owner of a copyrighted work(s) or a person authorized to act on behalf of the owner of the copyright or other intellectual property interest.
  7. Send the request to:

Counter Notification

Upon receipt of the above notice of infringement, DanceRecords.com will respond expeditiously to remove or disable access to the material that is claimed to be infringing or to be the subject of infringing activity as required by the Act. Joseph Teegarden will take reasonable steps to promptly notify the affected client. Such client may then give Joseph Teegarden a written counter notification that includes substantially the below. Pursuant to the Act such client will be liable for damages, including attorney fees, if the client misrepresent that a product or activity is not infringing the copyrights of others. If the client is not sure whether material infringes the copyrights of others, we recommend that the client first consult an attorney.

  1. Identify the material that has been removed or the material that access to has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  2. Provide information reasonably sufficient for DanceRecords.com to contact the client.
  3. Include the following statement: "I consent to the jurisdiction of the First Judicial District Court in the State of California, Alameda County, and that I will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person."
  4. Include the following statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled".
  5. Sign and date the counter notification.
  6. Send this notification to:

If DanceRecords.com’s client serves a counter notification complying with the above requirements, the DanceRecords.com will promptly provide the person who provided the initial infringement statement with a copy of the counter notification and will inform such person that DanceRecords.com will replace the removed material or cease disabling access to it within 10–14 business days. DanceRecords.com will then replace the removed material and cease disabling access to it within 10-14 business days following receipt of the counter notice unless the copyright owner gives Joseph Teegarden notice that it has filed an action seeking a court order against the client.


Injunction

If DanceRecords.com does receive a notification from a copyright holder who has procured an injunction prohibiting DanceRecords.com from providing access to allegedly infringing material, the client will be notified by E-Mail of the injunction. DanceRecords.com will follow the requirements of an enforceable injunction, anything to the above notwithstanding.
